At the beginning of this year, a new state law went into effect allowing property owners to “execute and file a restrictive covenant modification to an unlawful restrictive covenant,” see Public Act 102-110. Members of ILTA Title Counsel, Legislative, and Agents committees are in position to coordinate with county recorders, state's attorneys, and homeowner associations to craft a more uniform implementation of the new law that helps avoid compliance problems in the industry. Illinois is in line to implement remote notary regulations one year after enactment of Public Act 102-160. Members of ILTA Title Counsel, Legislative, and Settlement Services committees are in position to provide comment and administrative rule suggestions following the Secretary of State’s April 15th First Notice filing. Ever since an IDFPR crackdown on Anti-Predatory Lending Database (APLD) compliance, ILTA has worked on not only mitigating regulatory overreach but also improving the interaction with the APLD platform. While IDFPR has indicated a willingness to make APLD platform changes, more specific industry feedback/examples are needed.
